Availability of Products & Services
The Platform may offer and display various insurance products and services, however, you may not be eligible for all products and services and Daman reserves the right to determine such eligibility as permitted by UAE laws and regulations. Certain products or services may be subject to specific terms, conditions, representations or additional agreements which may need to be completed offline. The portions of this Platform related to such products and services provide additional information about the respective terms, conditions representations, agreements, eligibility and availability. If you purchase a product or service from Daman, the terms and conditions associated with your specific policy with Daman will apply.
Insurance Quotes, Premium Calculators, Coverage
Although the Platform offers online quotations, such feature may not be available for all products or coverage selections. Any online quotations generated by the Platform are estimates based on the information you provide, and are binding for the specified duration, but only if the information you provided in connection with such quotation does not change. The Platform may also offer online premium estimators. Such estimates are purely for illustrative purposes and are not binding. Any coverage descriptions provided on this Platform are general descriptions of available coverages and do not constitute a legally binding contract. To obtain coverage, you must submit an application to Daman, which may be subject to underwriting.
Online Claims Submissions
The Platform enables eligible Daman members, brokers and policyholders or authorised persons to submit online reimbursement claims. Your submission does not lead to automatic coverage of the claim. Information you submit in connection with such reimbursement is subject to review and verification. Daman reserves the right to request for additional information in order to make a decision on a claim, including requesting information from the relevant healthcare provider.
Completing Transactions
When entering into an electronic transaction on the Platform (e.g. opening an account, making an online payment, etc.) such transaction will not be completed until an “Electronic Instruction” (e.g. a message, request or communication issued or transmitted to Daman via the Platform) has been received and processed by Daman, and any specific steps or requirements as may be required, have been complied with.
You acknowledge that an Electronic Instruction may not have been received by Daman for reasons beyond either parties’ reasonable control, including, but not limited to, mechanical, software, telecommunications, or electronic failure, or the omission or failure of third party service providers or systems. You further acknowledge that Daman is not liable to you in any way for any loss or damage at all and howsoever caused, arising directly or indirectly, in connection with the transmission of an Electronic Instruction through the Portal, or any failure of Daman to receive an Electronic Instruction for whatever reason.
Online Payments
You may be able to make online payments in connection with certain product or service purchases through the Portal using approved bank cards. Your purchase of products or services through the Portal is conditional on Daman being able to successfully charge against your nominated bank card and/or Daman receiving all applicable payment amounts. Any approved refunds of a payment made through the Portal shall be done through the original mode of payment or through other modes as determined by Daman.
No Medical or Financial Advice
Daman does not, in any way, render medical or financial services and does not issue medical or financial advice. Although the Platform may enable you to locate physicians and healthcare providers, Daman does not: (i) recommend or endorse any specific tests, physicians, procedures, opinions, or other information that may appear on the Platform; if you rely on any of the information provided by the Platform, you do so solely at your own risk; and (ii) receive any additional fees from doctors or medical providers for listing them on the Platform.
Further, the Platform is not intended to provide tax, legal, insurance or investment advice, and nothing on the Platform should be construed as an offer to sell, a solicitation or an offer to buy, or a recommendation for any security by Daman or any third party. Unless otherwise specified, you alone are solely responsible for determining whether any investment, renewal, upgrade or any other product or service, is appropriate or suitable for you based on your objectives and personal and financial situation.
Ownership
Except for content that you submit, all of the Information available on or through the Platform, including, without limitation, the Daman name, text, photographs, graphics and video and audio content, is owned by us and our licensors and is protected by copyright, trademark, patent, and trade secret laws, other proprietary rights, and international treaties.
You acknowledge that the services and any underlying technology or software used in connection with the Platform constitute or contain Daman’s proprietary information. We give you permission to use the aforementioned content for personal, non-commercial purposes only and do not transfer any intellectual property rights to you by virtue of permitting you to use the Platform.
You may print, download, and store information from the Platform for your own convenience, but you may not copy, distribute, republish, sell, or exploit any of the content, or exploit the Platform in whole or in part, for any commercial gain or purpose whatsoever. Except as is expressly and unambiguously provided herein, Daman does not grant you any express or implied rights, and all rights in the Platform and the services not expressly granted by Daman to you are retained by Daman.
You acknowledge that violations (as determined through Daman’s sole discretion) of these intellectual property protections may lead to formal legal action. Save as set out in these Terms of Use, you have no right to use any of the intellectual property rights associated with the Platform without the prior written consent of Daman.
Content Posted or Submitted by You
Some portions of the Platform may permit you to post or submit content such as, text, images, and documents (“Posted Content”). To this end:
Daman reserves the right to maintain, delete or destroy all Posted Content to the Platform in accordance with its relevant information policies. Daman reserves the right to delete any Posted Content that it deems in its sole discretion fraudulent, abusive, defamatory, obscene or in violation of a copyright, trade mark or other intellectual property or ownership right of any other person and to suspend your access to the Platform in such circumstances.
Editorial Content
The Platform may make available certain editorial content as an informative and educational resource. Daman in no way guarantees the timeliness nor the accuracy of any or all of such content. Neither the authors, the editorial personnel, nor any other party who has been involved in the preparation or publication of this work can assure you that the information found on the Platform is fully accurate or complete, and they are not responsible for any errors or omissions or for the results obtained from the use of such information.
Third Party Content
The Platform may contain links to websites which are owned or operated by third parties independent of Daman or material (including services, information, graphics, or data) which is located on such third party. Daman does not guarantee the accuracy, timeliness, completeness or usefulness of any third party site or third party material, and is not responsible or liable for the same. Your use of third party sites and third party material is entirely at your own risk. The Platform may also contain links to information about special offers, deals or promotions by persons not related to or part of Daman. The inclusion of any third party offers on the Platform does not imply any sponsorship, endorsement, or approval of such offers, or of any third party material associated with these offers.
Daman makes no warranties or representations: (i) regarding the quality, accuracy, merchantability or fitness for purpose of any third party site, third party material, or products or services available through third party sites; or (ii) that third party material does not infringe the intellectual property rights of any person.
Eligibility & Registration
In order to make use of certain parts of the Platform, you, or your legal guardian, on your behalf, will need to register a or My Thiqa account (an “Account”). If you register for an Account, you must complete the registration process specified on the Platform by providing complete and accurate information as requested by the respective process. You must keep your registration data complete, accurate and up-to-date, and any loss caused by your failure to do so is your responsibility.
In connection with your Account, you will be given log-in credentials and you will select a password. It is your responsibility to maintain the confidentiality of your password and Account and you are also responsible for all activities that occur under your Account.
You agree to notify Daman immediately of any unauthorised use of your Account. Daman is not liable for any loss that you may incur as a result of someone else using your password or Account. We may suspend or terminate your Account or access to the Platform if we have a reasonable belief that it is being used in connection with fraudulent activity, or you breach the Terms of Use or for any other reason we determine in our sole discretion.
Daman reserves the right to terminate any Account that does not include a valid email address and telephone number on file as part of that individual’s Account. Both the email address and telephone number must be stored in the profile for your Account on the Platform.
You may cancel your Account at any time by contacting Daman.
Although Daman will do its best to protect your personal data, Daman cannot guarantee the security of your data transmitted to the Platform. Any transmission of data is at your risk.
Daman recognises industry standards and employs security safeguards to protect personally identifiable information from unauthorised access and misuse. All information you provide to Daman is stored on secure servers. Any payment transactions will be protected and safeguarded by encryption during data transit and storage. Daman does not disclose to third parties any personally identifiable information that you provide, except as necessary to provide the product or service you have specifically requested. Once Daman has received your information, Daman will use industry procedures and security features to try to prevent unauthorised access to that information.
Daman may contact you by telephone or email to verify your account information. Daman may request further information from you, which you agree to provide, in order to ensure you or a third party has not fraudulently created your account. If you do not provide any such information in the manner requested within seven (7) working days of the request, Daman reserves the right to suspend, discontinue or deny your access to the Platform until such time as the information is provided to Daman’s reasonable satisfaction.
You agree that you will not, and will not permit anyone else to:
Daman reserves complete discretion with respect to the operation of the Platform and may alter, withdraw, suspend or discontinue any functionality or feature of the Platform at any time. Daman is not responsible for transmission errors or corruption or compromise of information carried over local or interchange telecommunications carriers

Internet Connection Speeds
To use the Platform, you are required to have an active Internet connection with 1mbps of available bandwidth, for the best quality connection we recommend a minimum of 3mbps available bandwidth. Although you acknowledge that Daman does not guarantee a connection can be made or maintained at any time, Daman may deny or refuse your access to the Platform; suspend, change or update the Platform; and/or otherwise alter the Platform from time to time, at its sole discretion, and without notice.
You may link to the Platform home page provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link to the Platform on any website that is not owned by you. We reserve the right to withdraw linking permission at any time. The Platform must not be framed on any other site, nor may you create a link to any part of the Platform other than the home page.
The Platform is designed for, and intended for, users in the United Arab Emirates only, unless exclusively specified by Daman. Daman makes no representation that the information and/or the services provided via the Platform are applicable to, appropriate for, or available outside the UAE. Accessing the Platform services from territories where any content and/or services may be illegal is strictly prohibited.
We do not guarantee that the Platform will be secure or free from bugs or viruses.
You are responsible for properly configuring your Device and computer programs in order to access the Platform. You should use your own virus protection software. You are also responsible for ensuring that all persons who access the Platform through your internet connection are aware of and comply with these Terms of Use.
We provide the platform and the services “as is”, “with all faults” and “as available.” We make no express or implied warranties or guarantees about the platform. To the maximum extent permitted by law, we hereby disclaim all such warranties, including all statutory warranties, with respect to the services and the platform, including without limitation any warranties that the platform or services are merchantable, of satisfactory quality, accurate, fit for a particular purpose or need, or non-infringing. We do not guarantee that the results that may be obtained from the use of the platform will be effective, reliable or accurate or will meet your requirements. We do not guarantee that you will be able to access or use the platform (either directly or through third-party networks) at times or locations of your choosing. We are not responsible for the accuracy, reliability, timeliness or completeness of information provided by users of the platform or any other data or information provided or received through the platform. Except as expressly set forth herein, daman makes no warranties about the information systems, software and functions made accessible through the platform or any other security associated with the transmission of sensitive information. Daman does not warrant that the platform or the services will operate error-free, that loss of data will not occur, or that the services software or platform are free of computer viruses, contaminants or other harmful items.
You agree to defend, indemnify and hold harmless Daman and its respective directors, officers, managers, members, partners, stockholders, subsidiaries, employees, successors, heirs, assigns, agents and representatives from and against all claims, actions, demands, liabilities, costs and expenses, including, without limitation, reasonable attorneys’ fees, resulting from: (i) your breach of any provision of this Terms of Use or any representation or warranty you provide herein; (ii) inability to use, or errors caused by, the Platform; or (iii) use of, or reliance on, any content displayed on the Platform. You agree to cooperate fully with Daman in asserting any available defences in connection with a claim subject to indemnification by you under these Terms of Use.
In no event shall Daman be liable to you for any direct, indirect, incidental, special, compensatory, consequential, or punitive damages or any damages whatsoever, including but not limited to: (i) loss of goodwill, profits, business interruption, data or other intangible losses; (ii) your inability to use, unauthorised use of, performance or non-performance of the Platform; (iii) unauthorised access to or tampering with your personal information or transmissions; (iv) the provision or failure to provide any service; (v) errors or inaccuracies contained in the services or any materials or content obtained through the Platform; (vi) any transactions entered into through the Platform; (vii) any property damage including damage to your Device caused by viruses or other harmful components during or on due to access to or use of the Platform, including any site to which the Platform provides hyperlinks to; or (viii) damages otherwise arising out of your use of or access to the Platform, any services, or the content of any site or sites linked to the Platform. These limitations of liability shall apply regardless of the form of action, whether based on contract, tort, negligence, strict liability or otherwise.
We may terminate and/or suspend your Account and/or access to the Platform immediately, without notice, if there has been a violation of these Terms of Use or other policies and terms posted on the Platform by you or by someone using your credentials. We may also cancel or suspend your Account for any other reason, including inactivity for an extended period, but will attempt to notify you in advance of such cancellation or suspension. Daman shall not be liable to you or any third party for any termination of your Account and access to the Platform. Further, you agree not to attempt to use the Platform after any such deletion, deactivation or termination.
Entire Agreement
These Terms of Use and any supplemental terms, policies, rules and guidelines posted on the Platform, including all policies, constitute the entire agreement between you and us and supersede all previous written or oral agreements. If any part of these Terms of Use is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect and the remaining portions shall remain in full force and effect.
Modifications
We may change these Terms of Use at any time, as we reasonably deem appropriate. Upon any change in these Terms of Use, we will post the amended agreement on the Platform. Your continued use of the Platform shall constitute your affirmative acknowledgment of the Terms of Use, the modification and agreement to abide and be bound by the Terms of Use, as amended.
Applicable Law
These Terms and Conditions are governed by UAE law and you can bring legal proceedings in respect of the Platform in the Abu Dhabi courts.
Waiver
Even if we delay in enforcing any of these Terms of Use, we can still enforce them later. If we do not insist immediately that you do anything you are required to do under these Terms of Use, or if we delay in taking steps against you in respect of your breaching these Terms of Use, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
